Welcome to The Original Electrician ("Company", "we", "our", "us")! These Terms of Service ("Terms") govern your use of our website located at https://my-elect.com/ (together or individually "Service") operated by The Original Electrician.

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service.

Please read these Terms of Service carefully before using our Service.

2. Communications

By creating an Account on our Service, you agree to subscribe to newsletters, marketing or promotional materials, and other information we may send. However, you may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions provided in any email we send.

3. Purchases

If you wish to purchase any product or service made available through the Service ("Purchase"), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.

4. Contests, Sweepstakes, and Promotions

Any contests, sweepstakes, or other promotions (collectively, "Promotions") made available through the Service may be governed by rules that are separate from these Terms & Conditions. If you participate in any Promotions, please review the applicable rules as well as our Privacy Policy. If the rules for a Promotion conflict with these Terms and Conditions, the Promotion rules will apply.

6. Accounts

When you create an account with us, you guarantee that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on our Service.

7. Intellectual Property

The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of The Original Electrician and its licensors.

8. Links to Other Web Sites

Our Service may contain links to third-party web sites or services that are not owned or controlled by The Original Electrician.

The Original Electrician has no control over, and assumes no responsibility for the content, privacy policies, or practices of any third-party web sites or services. We do not warrant the offerings of any of these entities/individuals or their websites.

9. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

10. Indemnification

You agree to defend, indemnify and hold harmless The Original Electrician and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password, or b) a breach of these Terms.

11. Limitation of Liability

In no event shall The Original Electrician, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from: (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

12. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

13. Exclusions

Some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so the limitations above may not apply to you.

14. Governing Law

These Terms shall be governed and construed in accordance with the laws of Sarasota, FL without regard to its conflict of law provisions.

15. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

16. SMS

You can cancel the SMS service at any time. Simply text "STOP" to the phone number. Upon sending "STOP," we will confirm your unsubscribe status via SMS.

Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.

Carriers are not liable for delayed or undelivered messages. As always, message and data rates may apply for messages sent to you from us and to us from you. You will receive 2 messages per month. For questions about your text plan or data plan, contact your wireless provider.

17. Contract Terms, Payments, and Liability

Deposits


All deposits are 100% non-refundable and non-negotiable.

Change Orders


Change orders are charged at the rate of $225 per change, at $225 per hour plus the cost of all required materials, and are non-negotiable. Any alteration or deviation from the agreed-upon specifications involving additional cost will only be made upon written agreement. Such changes will become an extra charge above the original contract price and are to be paid immediately.

Standards of Work


Electricians shall install to the standards of the National Electrical Code. The Electrical Contractor is not responsible or liable in any way for any part of the existing electrical system.

Access and Property Disturbance


The Electrical Contractor shall make holes in the building as needed to gain access for routing cables or conduit and shall not be held liable in any way for labor or costs incurred for painting, texturing, or repairing walls, ceilings, or floors. The Electrical Contractor shall dig when necessary for the installation of wiring run underground and shall not be responsible for the repair of grass, sod, or landscaping. For a period of 30 days after digging is performed, any systems that could be affected by underground work require notifying the Electrical Contractor. Typical systems that may be affected include electrical, irrigation, cable, phone, and internet.

Permits and Inspections


Permits, inspections, and/or plans required for this work are the responsibility and liability of the party submitted to. The Original Electrician will pull an electrical permit from the local building department as required.

Delays


The Electrical Contractor will be excused for any delay beyond their control. These delays may include, but are not limited to, acts of God, labor disputes, inclement weather, acts of the owner or public authority, or other unforeseen contingencies.

Right to Stop Work and Payment Terms


If any payment under this contract is not made when due, the Electrical Contractor may suspend work on the job until such time as all payments have been made. It is agreed that payment to the Electrical Contractor shall not be withheld due to any delay or failed payments to the party submitted to. Payment is due upon completion of the work. Overdue accounts will be charged a late fee at the rate of 1.5% per month, or the maximum rate permitted by law. In addition, a compounding rate of $125 per day will be due until complete payment is made, including all fines of tardiness.

Attorney’s Fees and Costs


In the event that any party to this Contract commences any action, legal or otherwise, to collect the contract price, the prevailing party shall be entitled to recover attorney’s fees and costs incurred in connection with such action.

Estimate Validity


The estimate shall be effective for 30 days from the date first set forth. If the estimate is not accepted within this time, it shall expire. This estimate may also be withdrawn at any time prior to acceptance.

Substitution of Materials


The Electrical Contractor may substitute materials without notice to the Owner in order to allow work to proceed, provided that substituted materials are of no lesser quality than those listed in the job description.

Project Commencement and Termination


In the event the party submitted to does not request work to begin and/or the project is not in suitable condition to commence work within 30 days after acceptance of this Contract, the Electrical Contractor shall have the option to terminate this Contract.

Contract Interpretation and Severability


The language of this Contract shall in all cases be construed as a whole, according to its fair meaning, and not strictly for or against any of the parties. No provision shall be deemed dependent upon any other. If any provision of this Contract is held by an arbitrator or court to be unenforceable, invalid, or illegal, said provision shall be deemed deleted and shall not affect the validity of the remaining provisions of this Contract.
